Terms of Service for E-Trading Frontiers (HK)

Welcome to E-Trading Frontiers (HK)! These Terms of Service (“Terms”) govern your use of the ET Frontiers website and the services provided by ET Frontiers (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By accessing or using any part of the Service, you agree to be bound by these Terms. E-Trading Frontiers (HK) reserves the right to update and change these Terms from time to time without notice. E-Trading Frontiers (HK) is a global sourcing and refurbishment company specializing in mobile phones and spare parts. We provide B2B services including, but not limited to, sourcing used mobile phones, supplying spare parts, offering refurbishment services, and managing trade-in/recommerce programs. Our services are primarily intended for resellers, e-tailers, and service centers worldwide.

3. Account Registration and Use

• Eligibility: You must be at least 18 years old and capable of forming a binding contract to use our Service.
• Account Information: To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notifyE-Trading Frontiers (HK) immediately of any unauthorized use of your account or any other breach of security. E-Trading Frontiers (HK) will not be liable for any loss or damage arising from your failure to comply with this section.
• Business Use: If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms, and that business accepts these Terms.

4. Orders, Pricing, and Payments

• Quotes and Orders: All requests for quotes and orders are subject to availability and acceptance byE-Trading Frontiers (HK). Prices and availability are subject to change without notice.
• Payment Terms: Payment terms will be specified in your individual agreements or invoices. All payments are to be made in the currency specified byE-Trading Frontiers (HK).
• Shipping and Delivery: Shipping and delivery terms will be outlined in your specific order confirmations. E-Trading Frontiers (HK) is not responsible for delays caused by customs, shipping carriers, or other factors beyond our reasonable control.
• Taxes: You are responsible for all applicable taxes, duties, and customs fees associated with your orders.

5. Product Quality and Grading

• Grading Standards: Our mobile phones and parts follow industry-approved grading guidelines. Specific grading descriptions will be provided upon request or with your order.
• Refurbishment: Our refurbishment services are performed to a high standard, as outlined in our service agreements.
• Returns and Warranty: Details regarding product returns, refunds, and warranties will be specified in individual agreements or invoices.

6. User Conduct

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Engage in any fraudulent, abusive, or otherwise illegal activity.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

7. Intellectual Property

All content on the E-Trading Frontiers (HK) website, including text, graphics, logos, images, and software, is the property of ET Frontiers or its licensors and is protected by intellectual property laws. You may not use any content from the Service without the express written permission of ET Frontiers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. E-Trading Frontiers (HK) EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ET FRONTIERS MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

9. Limitation of Liability

IN NO EVENT SHALL E-Trading Frontiers (HK), ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Indemnification

You agree to indemnify and hold E-Trading Frontiers (HK) and its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Hong Kong to resolve any dispute arising out of these Terms or the Service.

12. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and E-Trading Frontiers (HK) regarding the use of the Service.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
